These general conditions of sale apply to the services provided by the establishment: any reservation implies acceptance of these conditions on the part of the customer. Only the specific clauses of the agreements signed with the customer may supplement, specify or even deviate from these conditions of sale.

Prices
Prices are expressed in euros including tax. They are per person for meal and/or drink services.
The applicable rates are those in effect at the time of booking. If, however, the reservation took place more than ten months before the date of the service, Le Bouchon Nivernais reserves the right to apply its rates in force at the time of the service, subject to prior notice provided for in the commercial proposal.
It is up to the customer to assess when booking whether the price suits them by accepting its fixed price nature. No dispute concerning the price of the service can be taken into consideration subsequently.

Reservation confirmation
Any reservation is only effective and confirmed after prior agreement from the establishment and subject to availability.
For group quotes, final confirmation will be requested seven days before the date of the service.

Menu confirmation
The commercial proposal or quote may include a choice between several menus.
In order to fully satisfy the customer, he must indicate his final choice to the restaurant no later than seven days before the service.
After this period, the restaurant cannot guarantee the service of certain dishes or wines on the menu.

Partial cancellation of the number of guests

The client must confirm the final number of guests no later than 3 days before the service takes place.

For any modification 3 days or less before the date of the service, regardless of the number of participants canceled or not present on the day of the service, the cancellation fee will be 100% of the unit price appearing in the initial quote, multiplied by the number of participants canceled.

Number of guests greater than expected when booking

If the number of guests is greater than the number announced, a supplement will be charged on the unit basis indicated in the commercial proposal or the initial quote.

However, in the event of too many additional participants being added:

  • Le Bouchon Nivernais cannot be held responsible for any impact on the quality of the service;
  • If this addition implied an excess of the restaurant's reception capacity, Le Bouchon Nivernais would be obliged to refuse to accommodate additional participants and could in no way be held responsible or questioned due to the refusal to accommodate. reception of additional participants for security reasons. 


Cancellation by Le Bouchon Nivernais

Any cancellation by Le Bouchon Nivernais, and except in cases of force majeure, results in the reimbursement of the sums paid by the customer as the deposit, to the exclusion of any other compensation.
The restaurant Le Bouchon Nivernais may release itself from its obligations or suspend performance in the event of any event beyond its control obstructing its normal operation, such as total or partial strikes by suppliers, subcontractors or carriers, interruption of transport. , the supply of energy, raw materials or in the event of force majeure (war, riots, demonstrations, disasters affecting the restaurant's facilities, etc.)

Progress of the service
On the day of the service, guests must arrive at the restaurant at the agreed time. In the event of a delay, the restaurant reserves the right to make guests wait. If this delay is more than one hour, the reservation will no longer be guaranteed.
No complaints about the progress of the service will be admissible after the day of the service.

Additional services not included in the commercial proposal or quote
Any additional service not included when booking – drinks, dishes – will be subject to additional billing on the same day of the service.

Customer Responsibility
The customer is deemed to have taken out civil insurance for any damage caused by his guests during the performance of the service, whether this is damage inflicted on other customers present or on the restaurant's property. He will be solely responsible for all losses, breakages and damage which could be caused by his guests to the goods and equipment belonging to the restaurant or those made available to the customer for rental.
The restaurant declines all responsibility in the event of damage or theft of valuables, handbags, briefcases, clothing, etc. belonging to guests or any material stored in its lounges.

Payment method

Any accepted means of payment (cash, bank card, ANCV, restaurant voucher, etc.) must be presented on site on the day of the service in order to pay the amounts due.
In certain cases agreed in advance with the customer in the quote or commercial proposal, the invoice will be given on the same day of the service and must be paid on site at the end of the service.
In any case, invoicing for the service will be made by accounting at the latest at the end of the month and must be paid upon receipt of the invoice.
Any amount not paid by the due date mentioned on the invoice will automatically and without prior notice result in late payment penalties at a rate equal to one and a half times the legal interest rate.
Any dispute regarding invoicing can only be taken into account within eight days following the date the invoice was sent.

Payment by Voucher or vouchers
This payment method is only applicable to companies under contract with Le Bouchon Nivernais.
The guide or tour leader of the group will give the restaurant a voucher corresponding to the order. No modification of this voucher will be accepted without prior agreement from the restaurant management. All “extras” must be paid on site on the day of the service.

Attribution of competence
In the absence of amicable settlement of any dispute or dispute concerning the interpretation or application of these general conditions, only the Paris commercial court will have jurisdiction.

Exceptional closure of the Bouchon Nivernais for holidays
